Selling terms and conditions Humanium Fair Trade Shop

The following selling terms and conditions concern Humanium association, headquartered in Geneva, Switzerland hereinafter referred to as "Humanium" and secondly any person or entity making a purchase on Humanium’s website, hereinafter referred to as "the purchaser".

Subject

The following general terms and conditions of sale intend to define the contractual agreements between Humanium and the purchaser as well as the conditions enforceable to each purchase made on Humanium’s merchandise website, whether the purchaser is a professional body or a consumer.

The purchase of products or of services through the website implies the full acceptance by the purchaser of the following terms and conditions of sale. These general terms and conditions of sale will prevail over all other general or specific conditions not expressly approved by Humanium.

Humanium reserves the right to modify its general terms and conditions of sale at any given moment and without prior notice. In this eventuality, the applicable conditions will be those which are in effect on the date of the order placed by the purchaser.

Characteristics of goods and services offered

The products and services sold are the ones that feature in the catalogue published on the website. These products and services are sold within the limit of stock availability. The photos and texts featured in the catalogue are as accurate as possible but cannot ensure an exact representation of the product, especially concerning colour.

Rates

The prices that appear in the catalogue are in Euros. Humanium is not responsible for the modification of exchange rates in other currencies. Humanium is recognised as a charitable association in Switzerland and the products sold are not subject to VAT in Switzerland.

Humanium reserves the right to amend its prices at any given moment, on the understanding that the catalogue price on the day of the order being placed will be the only price applicable to the purchaser.

The indicated prices do not include order processing, postage and delivery if they occur in the geographical zones stipulated at the time of placing the order on Humanium’s website.

Geographical area

Online sales of products and services displayed on the website are mainly reserved for purchasers who reside in Switzerland and mainland France.

For all other geographical areas, you must consult the conditions set out on the Humanium website and/or through a written agreement between the purchaser and Humanium.

Orders

Any purchaser who wishes to buy a product or service must:

– fill out the identification form which will show all the details required, or provide client ID if any, ensuring that all details are up-to-date (Humanium cannot be responsible for this);

– fill out the online order form, providing the references of all products and services chosen;

– confirm the order after checking it;

– make payment under the agreed terms;

– confirm the order and its payment.

The confirmation of the order implies acceptance of these terms and conditions, acknowledgement that it has been perfectly understood and foregoing the right to rely on the purchaser’s own terms of purchase or other conditions.

The information supplied and the recorded confirmation is taken as proof of the transaction. The confirmation is taken as signature and acceptance of the transaction.

Humanium reserves the right to cancel an order.

Revocation

The purchaser (non professional body only) benefits from a revocation delay of seven days, from the delivery of his/her order, to return the item to the seller for an exchange or a refund. However, the shipping is at the purchaser’s expense.

The product and their packaging must be in mint condition.

Payment terms

The payment is made at the end of the order for France and other countries. It can be paid on bill within 30 days for Switzerland. Late fee penalties will be required in this last case, as of 10% per month late.

Payments with credit cards are done by Paypal, company that uses the SSL (Secure Socket Layer) so the transmitted personal datas are encrypted by software and no one has access to it on the network.

Delivery

The items are delivered at the address indicated on the order, which can only be within an agreed geographic location.

The risks are borned by the purchaser from the moment the package leaves Humanium's office.

In case of damage during transportation, the claim must be made directly with the freight forwarder. Humanium will not be held responsible for damages that may happen during transportation.

The accuracy of the address and its delivery capacity is at the purchaser's responsability. In case the address is incorrect or outdated and the package underliverable, the purchaser can decid another delivery, at his own expense, or to cancel the order. In this case, only the sum of the item(s) will be refunded, not the delivery expenses.

The delivery delays are given for reference only : if they overrun thirty days from the day of the order, the sale contract will be cancelled and the purchaser reimbursed. The immediate availability of any products is not guaranteed.

Guarantee

Claims, exchange enquiries or refund enquiries must be sent through postal mail to Humanium within the seven days following the delivery, according to the conditions of the revocation clause.

Responsabilities

The seller, in the online selling process, is only supposed to provide the best endeavour possible; Humanium cannot be held responsible for any damages due to the use of the Internet such as data loss, intrusion, virus, network failure, or any other unintentional disturbances.

Intellectual Property

Each elements of the Humanium website are the exclusive intellectual property of Humanium and/or of its partners.

No one is authorized to reproduce, make use, duplicate, or use on any grounds, even partially, elements of the website whether they are written, softwares, visuals or acoustics.

Personnal datas

The Humanium Confidentiality Chart, available on the website, defines the limits of the protection of personnal datas. The purchaser’s personnal informations might be treated automatically.

The users have a right to access and to adjust their own datas.

Filing-Proof

Humanium will file every order forms and invoices on its website. The computerized registers and electronic mail exchanges will be considered by each party as proof of communications, orders, payments and transactions held between parties.

Dispute settlement

These general conditions of online purchases are subject to Swiss law. In the eventuality of a dispute, the settlement is allotted to the competent courts of Geneva in Switzerland. Under no circumstances the legal expenses shall fall under the responsibility of Humanium.
