This is a monumental development at the highest level that will influence policy and practice at international, national and local levels. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Children in street situations <\/span><b>suffer<\/b> <b>multiple<\/b> <b>violations<\/b><span style=\"font-weight: 400;\"> of their rights; they are both urgent and a complex issue for policy-makers to deal with. Until now there has never been an <\/span><b>authoritative<\/b> <b>interpretation<\/b><span style=\"font-weight: 400;\"> of the UN Convention on the Rights of the Child (hereinafter UNCRC) in relation to children in street situations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">General Comment No.21 will provide the guidance states need to scale up appropriate <\/span><b>rights<\/b><span style=\"font-weight: 400;\">&#8211;<\/span><b>based<\/b> <b>approaches<\/b><span style=\"font-weight: 400;\"> within this sector, enabling partnerships with non-government actors i.e. NGOs to be <\/span>agiler<b><\/b><span style=\"font-weight: 400;\"> and <\/span><b>more<\/b> <b>responsive<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Key Articles<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\"><b>Article 2:- Non-Discrimination<\/b><span style=\"font-weight: 400;\"> States are widely encouraged to <\/span><b>spread<\/b><span style=\"font-weight: 400;\"> the present general comment within governments, legal and administrative bodies, to children in street situations, parents and caregivers, private sector and civil society. <\/span><b>All<\/b> <b>channels<\/b> <b>of<\/b> <b>communication<\/b><span style=\"font-weight: 400;\"> are to be explored i.e. print media, internet and children&#8217;s own communication means such as <\/span><b>storytelling<\/b><span style=\"font-weight: 400;\"> should be used, including sign language and <\/span><b>easy<\/b> <b>to<\/b> <b>understand<\/b><span style=\"font-weight: 400;\"> formats for children with disabilities and limited literacy levels.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Article 6:- Right to Life<\/b><span style=\"font-weight: 400;\"> should not be interpreted narrowly. For example, in the case of <\/span><i><span style=\"font-weight: 400;\">Villagran Morales et al v Guatemala (1999)<\/span><\/i><span style=\"font-weight: 400;\"> where police officers tortured and murdered three children and two young people in street situations, the Inter-American Court of Human Rights ruled that arbitrary privation of life is not limited to the illegal act of homicide <\/span><b>but<\/b><span style=\"font-weight: 400;\"> extends to the deprivation of the right to live <\/span><b>with<\/b> <b>dignity<\/b><span style=\"font-weight: 400;\">. This case definitely requires an interpretation of the right to life that encompasses the <\/span><b>minimum<\/b> <b>conditions<\/b><span style=\"font-weight: 400;\"> for a life with dignity.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Article 6:- Right to Survival &amp; Development<\/b><span style=\"font-weight: 400;\"> States are expected to interpret \u201cdevelopment\u201d as a <\/span><b>holistic<\/b><span style=\"font-weight: 400;\"> concept, embracing the child\u2019s physical, mental, spiritual, moral, psychological and social development. Programmes can only be effective when they <\/span><b>acknowledge<\/b><span style=\"font-weight: 400;\"> the realities of children in street situations.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Potential Avenues<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">There are different approaches which can be used with respect to children in street situations : <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Child rights <\/b><span style=\"font-weight: 400;\">approach whereby the <\/span><b>child<\/b><span style=\"font-weight: 400;\"> is respected as <\/span><b>a<\/b> <b>right<\/b> <b>holder<\/b><span style=\"font-weight: 400;\"> and decisions are often made with the child.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Welfare<\/b><span style=\"font-weight: 400;\"> approach involving the \u201c<\/span><b>rescue<\/b><span style=\"font-weight: 400;\">\u201d of children, whereby the child is perceived to be an object or victim of street and decisions are made for the child <\/span><b>without<\/b> <b>serious<\/b> <b>consideration<\/b><span style=\"font-weight: 400;\"> of his or her view.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>A repressive<\/b><span style=\"font-weight: 400;\"> approach whereby the child is perceived to be a <\/span><b>delinquent<\/b><span style=\"font-weight: 400;\">. <\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The welfare and repressive approaches <\/span><b>fail<\/b><span style=\"font-weight: 400;\"> to take into account the child as a right holder which <\/span><b>further<\/b> <b>violates<\/b> <b>their<\/b> <b>rights<\/b><span style=\"font-weight: 400;\"> by forcibly removing a child from the street.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hence applying a child rights approach is not only a <\/span><b>moral<\/b><span style=\"font-weight: 400;\"> and <\/span><b>legal<\/b> <b>imperative<\/b><span style=\"font-weight: 400;\"> but also the <\/span><b>most<\/b> <b>sustainable<\/b><span style=\"font-weight: 400;\"> approach for identifying and implementing long-term solutions with children in street situations.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4><b><i>\u201cLiving on the streets does not mean that we cannot have rights&#8221;<\/i><\/b><\/h4>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Although the UNCRC does not explicitly refer to children in street situations, the Committee states \u201c<\/span><b>all<\/b><span style=\"font-weight: 400;\"> of its provisions <\/span><b>are<\/b> <b>applicable<\/b><span style=\"font-weight: 400;\"> to children in street situations who experience violations of a large majority of the Convention\u2019s articles\u201d. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In total <\/span><b>327<\/b> <b>children<\/b><span style=\"font-weight: 400;\"> and <\/span><b>young<\/b> <b>people<\/b><span style=\"font-weight: 400;\"> who are in street situations from <\/span><b>32<\/b> <b>countries<\/b><span style=\"font-weight: 400;\"> were consulted in seven regional consultations.<\/span><\/p>\n<p>A child rights approach <b>ensures<\/b> <b>respect<\/b> for the dignity, life, survival, wellbeing, health and development, participation, right to be heard and non-discrimination of the child as a rights holder.<\/p>\n<p><span style=\"font-weight: 400;\">Data is <\/span><b>not systematically collected<\/b><span style=\"font-weight: 400;\"> so it is not known how many children are in street situations. The absence of data makes these children invisible which leads to policies not being developed or measures that are <\/span><b>short-term<\/b><span style=\"font-weight: 400;\">. This concerns <\/span><b>every state.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In 1993 there was a surge of international interest in street children following <\/span><i><span style=\"font-weight: 400;\">Candelaria<\/span><\/i> <i><span style=\"font-weight: 400;\">Massacre<\/span><\/i><span style=\"font-weight: 400;\"> in Rio de Janeiro where 8 street children were shot dead and several others were wounded by police whilst sleeping on the steps of a church.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The international community severely condemned the attack and many in Brazil asked for the prosecution of those who shot the children. This massacre <\/span><b>highlights<\/b><span style=\"font-weight: 400;\"> the <\/span><b>dangers<\/b><span style=\"font-weight: 400;\"> that children in street situations face.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Children in street situations are <\/span><b>diverse<\/b><span style=\"font-weight: 400;\"> in terms of age, sex, ethnicity, nationality, disability, sexual orientation. This diversity implies <\/span><b>different<\/b> <b>experiences<\/b><span style=\"font-weight: 400;\">, risks and needs.
