{"id":30760,"date":"2019-11-18T20:28:20","date_gmt":"2019-11-18T20:28:20","guid":{"rendered":"https:\/\/www.humanium.org\/en\/?p=30760"},"modified":"2025-12-13T20:44:59","modified_gmt":"2025-12-13T20:44:59","slug":"thirty-years-since-the-convention-on-the-rights-of-the-child-childrens-rights-improvements-and-problems-all-over-the-world","status":"publish","type":"post","link":"https:\/\/www.humanium.org\/en\/thirty-years-since-the-convention-on-the-rights-of-the-child-childrens-rights-improvements-and-problems-all-over-the-world\/","title":{"rendered":"Thirty years since the Convention on the Rights of the Child &#8211; children&#8217;s rights improvements and problems all over the world"},"content":{"rendered":"\n<p><strong>Thirty years ago, on November 20<sup>th<\/sup> 1989 the <\/strong><a href=\"https:\/\/www.humanium.org\/en\/convention\/\"><strong>Convention on the Rights of the Child<\/strong><\/a><strong> was adopted and opened for signature, ratification and accession by General Assembly resolution in the New York headquarters of the United Nations.&nbsp;<\/strong><\/p>\n\n\n\n<p>The Resolution in the form of 54 articles with 140 signatories has become the most widely ratified human rights treaty in history and has helped transform children\u2019s lives around the world.&nbsp; The Convention has had a massive impact; however, despite this, there are many challenges child rights are still confronted with around the world.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How does the Convention define and\nprotect a child?<\/strong><\/h2>\n\n\n\n<p>The Convention defines a &#8220;child&#8221; as a person under the age of 18 unless the relevant laws recognise an earlier minimum age. In some areas, states are obliged to set minimum ages, such as the age for admission to employment and completion of compulsory schooling; in others, however, the Convention clearly prohibits life imprisonment with no possibility of release or the death penalty for persons under 18 years of age. <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"691\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771.jpg\" alt=\"\" class=\"wp-image-30768\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771.jpg 1000w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771-300x207.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771-768x531.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771-830x574.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771-230x159.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771-350x242.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_557866771-480x332.jpg 480w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<p>To protect children there are four\nso called \u201cgeneral principles\u201d put into place:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Non-discrimination (article 2)<\/strong><\/li><li><strong>Best interest of the child\n(article 3)<\/strong><\/li><li><strong>Right to life survival and\ndevelopment (article 6)<\/strong><\/li><li><strong>Right to be heard (article 12)<\/strong><\/li><\/ol>\n\n\n\n<p>These principles are the cornerstones of child rights in the modern world and along with optional protocols they serve to form the basis of the rules that provide protection, opportunities and equality to all minors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What\nhave the accords achieved?<\/strong><\/h2>\n\n\n\n<p>Since the accords child protection legislation has been adopted in almost all developing countries while regional and national initiatives have emerged in response to the problems of child trafficking, harmful and dangerous child labour, homeless children and unaccompanied children. After the signing of the accord\u2019s countries such as Tunisia, Angola or Bangladesh implemented clauses on child rights into their constitutions. <\/p>\n\n\n\n<p>The recognition of children&#8217;s right to protection has led to increased awareness towards child vulnerability and to important initiatives to respond to neglect and abuse, including possible abuses by corrupt or illegitimate child service providers or even dangerous criminal rings.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The Statistics:<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Child poverty has halved since the\nsigning of the Convention on the rights of the child.<\/strong><\/li><li><strong>Thanks to the improvement in maternal care, the chances\nthat a child will die before their fifth birthday has equally halved since\n1989.<\/strong><\/li><li><strong>According to the World Bank only 8.2 per cent of primary\naged children do not attend school in 2019 compared to 17.6 per cent in 1989.<\/strong><\/li><li><strong>56 countries have prohibited any form of corporal punishment\ntowards children since the signing of the convention, 61 countries in total\nhave laws forbidding corporal punishment towards children.<\/strong><\/li><\/ol>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174.jpg\" alt=\"\" class=\"wp-image-30769\" width=\"285\" height=\"189\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174.jpg 1000w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174-300x200.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174-768x512.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174-830x554.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174-230x153.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174-350x233.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_303194174-480x320.jpg 480w\" sizes=\"auto, (max-width: 285px) 100vw, 285px\" \/><\/figure><\/div>\n\n\n\n<p>The convention has directly and indirectly improved the lives of children all over the world through change in global legislation and generally heightened awareness towards the vulnerability of children. It can be safely said that no convention has ever had such a powerful impact on the quality of life children can expect around the world.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Where\nare child rights still abused?<\/strong><\/h2>\n\n\n\n<p>While the Convention certainly has had a large positive impact\non the lives of minors, child abuse and disrespect of child rights remains\nrampant in many parts of the world.<\/p>\n\n\n\n<p>In poverty-stricken countries large percentages of children go\ninto employment having completed very little or no education whatsoever. This\nis most prevalent in sub-Saharan and western African countries where Chad,\nBurkina Faso, Guinea Bissau, Cameroon and Sierra Leone all have over 50 per\ncent of children between the ages of 7 and 14 in some form of full-time\nemployment. &nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p>The types of employment these children go through are often\ndangerous and unregulated.&nbsp; In central\nand east Africa clandestine groups often have more power over certain regions\nthan legitimate governments of the land, in cases of civil war or national\nunrest this means that local populations are often forced to work for the\nopposition in different ways and this includes children. For instance, the latest research by the United\nNations Children&#8217;s Fund (UNICEF) estimates 40,000 children are working in DRC\nmines, mining the cobalt that goes into our phone batteries for under one\ndollar a day.&nbsp; <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025.jpg\" alt=\"\" class=\"wp-image-30770\" width=\"341\" height=\"191\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025.jpg 1000w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025-300x169.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025-768x432.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025-830x467.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025-230x129.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025-350x197.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2019\/11\/shutterstock_1186227025-480x270.jpg 480w\" sizes=\"auto, (max-width: 341px) 100vw, 341px\" \/><\/figure><\/div>\n\n\n\n<p>The other great threat posed towards children on the continent is that of being conscripted as a child soldier. Both armed opposition groups and government militias are responsible for these crimes with an estimated 120 000 child soldiers on the continent. Child soldiers are forcefully conscripted from conflict zones due to the few opportunities awaiting them, the fact that they can be manipulated more easily than an adult and, in some cases, due to their limited understanding of death.<\/p>\n\n\n\n<p>It is however too easy to\npoint the finger at developing nations and regions in conflict. Child detention\nis all too common in first world countries&nbsp;in the United States\n(the only country that hasn\u2019t ratified the CRC) alone&nbsp; 20,000 unaccompanied children were\napprehended this spring by ICE officials and affiliates. Countries such as\nAustralia, Hungary and Greece also face charges towards the way they detain\nminors.<\/p>\n\n\n\n<p>Pre 2012 the convention\ncould be interpreted to allow child migrant detention:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>\u201cNo child shall be deprived of his or her liberty unlawfully or arbitrarily. The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time\u201d. <em>&nbsp;&nbsp;<\/em><\/strong><\/p><\/blockquote>\n\n\n\n<p>However, this article does not specifically refer to the detention of migrant children. It refers to the detention of children in all situations, including detainment of children convicted of crimes, serious health problems or children in need of immediate protection.<\/p>\n\n\n\n<p>The issue of migrant children was clarified in 2012 and the CRC adopted stricter standards. The norm today is that the detention of children in immigrant detention centres is still a violation of children&#8217;s rights. The UN CRC clarified children&#8217;s rights in the context of migration as part of the non-binding day of general discussion. The Committee on the Rights of the Child has made this issue clear:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>\u201cThe detention of a child because of their or their parent\u2019s migration status constitutes a child rights violation and always contravenes the principle of the best interests of the child. In this light, States should expeditiously and completely cease the detention of children on the basis of their immigration status\u201d.<\/strong><\/p><\/blockquote>\n\n\n\n<p>The problem\nwith the amendment is the fact that it\u2019s of a non-binding nature, leaving it as\nlittle more than a suggestion for countries to take on in good will. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The\nCRC and Humanium<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/www.humanium.org\/en\/presentation\/\">Humanium <\/a>was founded on the date of the signing 11 years ago with a single goal: the well-being of children worldwide. <\/p>\n\n\n\n<p>Our association strives for a concrete improvement in\ntheir living conditions and their basic rights.<\/p>\n\n\n\n<p>Humanium\u2019s objectives span three complementary approaches:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Raising awareness of children\u2019s rights to more than five million people each year worldwide<\/li><li>Legal assistance for victims of children\u2019s rights violations<\/li><li><a href=\"https:\/\/youtu.be\/GrPI48YM9Ms\">Supporting local partners with projects to help children<\/a><\/li><\/ul>\n\n\n\n<p>The organisation has currently 5 projects in the field in Rwanda and in India, each of them with the purpose of improving the lives of children through empowering local communities and helping individuals find more opportunities.
