This is certainly a landmark ruling for environmental rights, requiring oil companies\u2019 accountability for the environmental and <\/strong><a href=\"https:\/\/www.humanium.org\/en\/fundamental-rights-2\/health\/\"><strong>health<\/strong><\/a><strong> impacts of their activities<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Healthy environment \u2013 a right and a privilege<\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.humanium.org\/en\/focus-on\/environment\/environmental-rights\/\">right to live in a healthy and clean environment<\/a>, the <a href=\"https:\/\/www.humanium.org\/en\/fundamental-rights-2\/health\/\">right to health<\/a>, the right to <a href=\"https:\/\/www.humanium.org\/en\/water\/\">water<\/a> and the right to <a href=\"https:\/\/www.humanium.org\/en\/food\/\">food<\/a> are essential human rights, which are not yet fully guaranteed in the world, exposing individuals and entire communities of our planet to serious social, environmental and <a href=\"https:\/\/www.humanium.org\/en\/focus-on\/environment\/climate-emergency\/\">climatic injustices<\/a>.<\/p>\n\n\n\n<p>In the <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuadorian<\/a> Amazon, for example, people have been fighting for a long time against &#8220;<em>gas flaring<\/em>&#8220;, a practice linked to the oil industry that for decades has been disrupting the delicate and complex local ecosystem and is rapidly undermining the well-being and <a href=\"https:\/\/www.humanium.org\/en\/fundamental-rights-2\/health\/\">health<\/a> of the people who inhabit those extraordinary lands (World Rainforest Movement, 2019).<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"681\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-1024x681.jpg\" alt=\"\" class=\"wp-image-44148\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-1024x681.jpg 1024w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-300x199.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-768x511.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-1536x1021.jpg 1536w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-2048x1361.jpg 2048w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-830x552.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-230x153.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-350x233.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-480x319.jpg 480w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_655707079-1-272x182.jpg 272w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Burning the natural gas that escapes from oil wells as a byproduct of petroleum at an average temperature of 400\u00b0 Celsius (750\u00b0 Fahrenheit) 24-hours a day, year-round, and in residential areas with no protection for exposed families, has been an established practice in the <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuadorian<\/a> Amazon since 1967, when Chevron-Texaco began drilling the first commercially valuable oil (Earth.org, 2021).&nbsp;<\/p>\n\n\n\n<p>The high levels of air pollution, soil and water contamination are directly related to the high incidence rate of cancer, malformations, miscarriages and deaths among the population living near more than 447 oil towers operating in that vast area (Amazon Frontlines, 2021).&nbsp; Pablo Fajardo, one of the lawyers who represents the girls and the Union of People Affected by Texaco (UDAPT), has said that UDAPT and Cl\u00ednica Ambiental spent two years compiling records of cancer cases in Sucumb\u00edos and Orellana. They documented 251 such cases, with women accounting for 71% of them (Earth.org, 2021).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A historical victory for nature and the Ecuadorian community<\/strong><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cI\u2019m very happy because, finally, justice has been served. We\u2019re going to restore nature, for all the sick children, for the people, for the parents who have fought to stay healthy, for the families that have also kept fighting if only to grow a few crops, for the families who live under the flares and have had to abandon their land.\u201d<\/em><\/p><cite>&#8211; Leonela Moncayo, 10 years old<\/cite><\/blockquote>\n\n\n\n<div class=\"wp-block-image is-style-default\"><figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-1024x681.jpg\" alt=\"\" class=\"wp-image-44172\" width=\"453\" height=\"300\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-1024x681.jpg 1024w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-300x200.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-768x511.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-1536x1022.jpg 1536w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-2048x1363.jpg 2048w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-830x552.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-230x153.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-350x233.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/06\/shutterstock_111898520-480x319.jpg 480w\" sizes=\"auto, (max-width: 453px) 100vw, 453px\" \/><\/figure><\/div>\n\n\n\n<p>On January 26, 2021, nine young <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuadorian<\/a> girls, Leonela Moncayo, Rosa Valladolid, Skarlett Naranjo, Jamileth Jurado, Denisse Nu\u00f1ez, Dannya Bravo, Mishell Mora, Jeyner Tejena, and Kerly Herrera, and their respective communities of origin, won the appeal filed on February 20, 2020 before the Provincial Court of Justice of Sucumb\u00edos, in which they asked the State of <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuador<\/a> &#8211; formally the Ministry of Energy and Non-Renewable Natural Resources and the Ministry of Environment and Water Resources &#8211; to assume its environmental responsibilities, to ban the criminal practice of &#8220;gas flaring&#8221; and to close all existing oil towers (Mongabay, 2021).<\/p>\n\n\n\n<p>The legal case on gas flaring in <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuador<\/a> was brought by the nine girls through a collaboration of several civil-society organizations, including UDAPT and the Clinica Ambiental, and others forming the Ecuadorian Alliance for Human Rights, such as Acci\u00f3n Ecologica and Amazon Frontlines, among others (Amazon Frontlines, 2021).<\/p>\n\n\n\n<p>According to the relevant judgment, the <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuadorian<\/a> State has ignored the right of the plaintiffs to live in a <a href=\"https:\/\/www.humanium.org\/en\/focus-on\/environment\/environmental-rights\/\">healthy and ecologically balanced environment<\/a> and has also violated their <a href=\"https:\/\/www.humanium.org\/en\/fundamental-rights-2\/health\/\">right to health<\/a> due to the inability (or unwillingness) of the state authorities to promote the use of &#8220;clean&#8221; technologies and\/or renewable and non-polluting energy sources.<\/p>\n\n\n\n<p>Furthermore, the ruling has also recognized that <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuador<\/a> has systematically violated its international obligations on <a href=\"https:\/\/www.humanium.org\/en\/focus-on\/environment\/climate-emergency\/\">climate change<\/a>, and its national commitments to reduce CO<sub>2<\/sub> emissions into the atmosphere. These in fact would decrease by 24% if the 447 oil towers were to stop operating (UNDP, 2021). Alternatively, natural gas could be used for domestic use or for power generation to fuel local oil facilities. This would put it back into the process and prevent its combustion. <\/p>\n\n\n\n<p>These solutions will be adoptable when the oil industry resorts to new standards and innovative, sustainable procedures (UNFCCC, 2021). For the local communities and for the entire country, this is an historic victory, which has paved the way for a series of proceedings for reparation and compensation for the damages caused to the victims concerned.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A right to health should override economics<\/strong><\/h2>\n\n\n\n<p>The country&#8217;s oil industry and, in particular, the prestigious state oil company <em>Petroamazonas<\/em>, must now account for its actions and its harmful consequences in the provinces of Sucumb\u00edos and Orellana. After intimating the <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuadorian<\/a> State to respect and not delegitimize the aforementioned ruling and to immediately apply its provisions for the common good, avoiding bending to the short-sighted interests of business and the economy, Pablo Fajardo, has stressed that \u201c<em>economic interests cannot prevail over life and nature\u201d <\/em>(The Ecologist, 2020)<em>.&nbsp;<\/em><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c<em>These girls who today were petitioners could tomorrow be victims of cancer.<\/em>\u201d<\/p><cite>&#8211; Pablo Fajardo<\/cite><\/blockquote>\n\n\n\n<p>In the same hours of the ruling, another piece of news expected by environmental movements in the <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuadorian<\/a> Amazon finally arrived. Three European banks, BNP Paribas, Credit Suisse and ING, announced on Monday that in response to environmental criticism they will stop financing oil trade from the Amazon region of <a href=\"https:\/\/www.humanium.org\/en\/ecuador\/\">Ecuador<\/a> (Aljazeera, 2021). The two major NGOs advocating for this policy change are Amazon Watch and Stand.earth.&nbsp;<\/p>\n\n\n\n<p>The last few months have seen a major step forward the recognition of environmental rights and have reaffirmed how crucial the work of NGOs and child environmental activists all around the world is in shaping policies. Their commitment will have important life-enhancing effects on entire communities of people, who can finally hope for a better future where their rights may be finally recognized.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Humanium\u2019s efforts to ensure a healthy environment<\/strong><\/h2>\n\n\n\n<p>As an organization, Humanium has recognized the importance of <a href=\"https:\/\/www.humanium.org\/en\/focus-on\/environment\/\">children\u2019s environmental rights<\/a> and is working hard to create a world where such rights are respected and fulfilled.
