{"id":44901,"date":"2021-08-03T07:09:07","date_gmt":"2021-08-03T07:09:07","guid":{"rendered":"https:\/\/www.humanium.org\/en\/?p=44901"},"modified":"2025-12-05T16:14:31","modified_gmt":"2025-12-05T16:14:31","slug":"hungarys-new-anti-lgbtqi-law-deterioration-of-the-spirit-of-understanding-peace-and-tolerance","status":"publish","type":"post","link":"https:\/\/www.humanium.org\/en\/hungarys-new-anti-lgbtqi-law-deterioration-of-the-spirit-of-understanding-peace-and-tolerance\/","title":{"rendered":"Hungary&#8217;s new anti-LGBTQI+ law: deterioration of the spirit of understanding, peace and tolerance"},"content":{"rendered":"\n<p><strong>On 15 June 2021, the <\/strong><a href=\"https:\/\/www.humanium.org\/en\/hungary\/\"><strong>Hungarian<\/strong><\/a><strong> government passed a new law that was quickly followed by international outrage. The law, originally drafted to further criminalise paedophilia, could have severe consequences on the rights of <\/strong><a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\"><strong>LGBTQI+ children<\/strong><\/a><strong>. However, the <\/strong><a href=\"https:\/\/www.humanium.org\/en\/hungary\/\"><strong>Hungarian<\/strong><\/a><strong> government has insisted that the law was passed to protect the children and their rights. What does this newly enacted law change and does it really protect children?<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>An anti-paedophilic law amended<\/strong><\/h2>\n\n\n\n<p>In the spring of 2019, the former <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> ambassador to Peru, Gab\u00f3r Kaleta, was apprehended in relation to nearly 20,000 pornographic pictures of minors that were found on his computer (Andr\u00e1s &amp; Zolt\u00e1n, 2020).&nbsp; Kaleta was penalised with a \u20ac1500 fine and a suspended prison sentence, which was considered by many to be a slap on the wrist and an insult to those affected (Zolt\u00e1n, 2021). In the wake of this scandal, the <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> legislator took steps to ensure that convicted paedophiles were punished more severely.&nbsp;<\/p>\n\n\n\n<p>However, before the final vote on the legislative draft, key legislative amendments were added. What started as a law condemning and punishing paedophilic crimes, was twisted and turned in an attempt to conflate paedophilia and <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> minorities (Zolt\u00e1n, 2021). Sadly, this is not the first time <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungary<\/a> has undertaken legislative steps to erode the position of the <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> community in <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> society (Attila &amp; Kov\u00e1cs, 2020).&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Hungarian law explained<\/strong><\/h2>\n\n\n\n<p>The first point of law that is under heavy scrutiny is that \u201cno content featuring portrayals of homosexuality or sex reassignment can be made available to minors\u201d (Zolt\u00e1n, 2021). This could effectively prohibit all media such as, but not limited to, TV shows, movies and music which include <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> related content from being shown to minors. This could mean that shows such as Modern Family and instalments of the Harry Potter franchise would not be available to the public until after 11 PM and are grouped in the same category as the goriest of horrors (Zolt\u00e1n, 2021).&nbsp;<\/p>\n\n\n\n<p>One (further) issue is that this law has not been properly defined. Nowhere does the law stipulate what can be considered as a \u2018portrayal\u2019 of homosexuality or sex reassignment. It therefore remains unclear which media is caught under this newly enacted prohibition. Moreover, the law prohibits advertising that includes <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> related content. This could mean that companies with advertising campaigns celebrating <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> people and promoting mutual respect amongst all are barred from being shown to the public at large.<\/p>\n\n\n\n<p>The second point of law stipulates that school sex educators can no longer promote homosexuality or sex reassignment. Much like the previous point, the law does not provide a definition of what is considered to be the \u2018promotion\u2019 of <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> topics. However, it could well mean that children will no longer receive a variation of information regarding <a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\">sex, sexual relations and sexual orientations<\/a>. Moreover, <a href=\"https:\/\/www.humanium.org\/en\/right-to-education\/\">sexual education<\/a> classes can only be held by registered organisations, further reducing <a href=\"https:\/\/www.humanium.org\/en\/right-to-education\/\">sexual education<\/a> to a narrative agreed upon through governmental licensing (Zolt\u00e1n, 2021). A narrative which has been proven to be far from inclusionary (Gyollai &amp; Korkut, 2020).&nbsp;<\/p>\n\n\n\n<p>This narrative prompts another worry. Undefined terms in the law, such as \u2018portrayal\u2019 and \u2018promotion\u2019, will have to be interpreted through either governmental guidance or litigation. In either case, given the current legal trend in Hungary, it is likely that terms such as these will be interpreted broadly and in favour of the current narrative.<\/p>\n\n\n\n<p>Understandably, many human rights groups and governments have voiced their concerns (Siebold &amp; Baczynska, 2021). However, amidst the storm of debate that encircles the latest <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> legislative move, the focus is lost on the true purpose of the law. What might have started as an admirable cause, namely for ensuring the protection of children and the rights thereof, now begs the question &#8211; does this new law genuinely protect children?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The laws protecting children<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/www.humanium.org\/en\/convention\/\">The Convention on the Rights of the Child<\/a> (CRC) is considered to be the most widely adopted and authoritative legal source for the protection of children (Tobin, 2019). Currently 196 states have <a href=\"https:\/\/www.humanium.org\/en\/convention\/signatory-states\/\">adopted the children\u2019s rights instrument<\/a>, amongst which is also <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungary<\/a>. The states which have adopted the <a href=\"https:\/\/www.humanium.org\/en\/convention\/\">CRC<\/a> are under an obligation to shape their laws and policies with the rights enshrined therein as their guiding light (UNICEF, 2007). It is therefore important to compare and contrast the <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> provisions to the rights contained within the <a href=\"https:\/\/www.humanium.org\/en\/convention\/\">CRC<\/a>.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"731\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-1024x731.jpg\" alt=\"\" class=\"wp-image-44903\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-1024x731.jpg 1024w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-300x214.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-768x548.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-1536x1097.jpg 1536w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-2048x1462.jpg 2048w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-830x593.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-230x164.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-350x250.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2021\/08\/shutterstock_178534223-480x343.jpg 480w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Article 13 of the CRC states that children have the <a href=\"https:\/\/www.humanium.org\/en\/right-to-freedom\/\">right to freedom of expression<\/a>. It is important to note that the <a href=\"https:\/\/www.humanium.org\/en\/right-to-freedom\/\">right to freedom of expression<\/a> is not specific to children\u2019s rights, it is considered in almost every major human rights instrument (Tobin &amp; Parkes, 2019). It was included in the <a href=\"https:\/\/www.humanium.org\/en\/convention\/\">CRC<\/a> to entrench this right for children, seeing that it was a right often overlooked or neglected (Tobin &amp; Parkes, 2019). The <a href=\"https:\/\/www.humanium.org\/en\/right-to-freedom\/\">right to freedom of expression<\/a> needed to be entrenched because it is considered to be an essential element of human dignity and the development of the child, and is considered to be the cornerstone of a democratic society (Tobin &amp; Parkes, 2019).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Children\u2019s right to freedom severely affected<\/strong><\/h2>\n\n\n\n<p>It is, simply put, essential for adults and children that the <a href=\"https:\/\/www.humanium.org\/en\/right-to-freedom\/\">right to freedom of expression<\/a> is not narrowly construed. This right implies the right to seek, receive and impart information. The scope of this right is wide, but for the purpose of the <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> law, the right to seek and receive information is of particular relevance. This right, often referred to as the right to access information, firstly ensures that children have access to information and ideas of all kinds. <\/p>\n\n\n\n<p>This includes, but is not limited to information and ideas relating to information regarding <a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\">sexual orientation<\/a> and gender identity (Thoreson, 2015; Tobin &amp; Parkes, 2019). Better yet, such information is considered to be a critical part of children\u2019s right to access information (Thoreson, 2015). It is critical, since sexual development, such as <a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\">sexual orientation<\/a>, starts at a very early age (Cacciatore et al., 2019).<\/p>\n\n\n\n<p>Secondly, the right to access information stipulates that the child is free in choosing what media it uses to seek and receive information. This includes avenues such as the educational system and mass media. As such, Article 29 of the CRC obliges the state to ensure educational systems which would provide for the necessary information regarding <a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\">sexual orientation<\/a> and gender identity for the purpose of children\u2019s personal development (Tobin &amp; Parkes, 2019). <\/p>\n\n\n\n<p>More importantly, Article 17 of the CRC stresses the crucial roll mass media has in the provision and dissemination thereof for children (Tobin &amp; Handsley, 2019; Tobin &amp; Parkes, 2019; UNICEF, 2007).&nbsp; To summarise, the <a href=\"https:\/\/www.humanium.org\/en\/right-to-freedom\/\">right to freedom of expression<\/a> entails that children should have access to information regarding <a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\">sexual orientation<\/a> and gender identity through a multitude of source, amongst which are the educational system and mass media.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>In the spirit of understanding<\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> law prohibits mass media from providing children with <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> related information and prohibits sexual educators to educate children on <a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\">sexual orientation<\/a> and gender identity. In light of the above, it is an understatement that this severely impedes the effective enjoyment of the right to access information. Not only will the regulation greatly restrict the flow of <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTQI+<\/a> related information to children, but it will do so by restricting one of the most popular and crucial sources of information for children &#8211; the mass media.&nbsp;<\/p>\n\n\n\n<p>Prohibitions such as these encourage stigmatisation and <a href=\"https:\/\/www.humanium.org\/en\/discrimination\/\">discrimination<\/a> against <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">&nbsp;LGBTQI+ children<\/a> (Sandberg, 2015). What\u2019s even worse, stigmatisation and <a href=\"https:\/\/www.humanium.org\/en\/discrimination\/\">discrimination<\/a> against <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">&nbsp;LGBTQI+ children<\/a><strong> <\/strong>have gone hand-in-hand with <a href=\"https:\/\/www.humanium.org\/en\/abuse\/\">violence<\/a>, perpetrated either <a href=\"https:\/\/www.humanium.org\/en\/physical-and-virtual-violence-bullying-in-schools-a-worldwide-problem-to-address\/\">by others<\/a> or due to <a href=\"https:\/\/www.humanium.org\/en\/child-suicide\/\">self-harming<\/a> (Gerber &amp; Timoshanko, 2021). In other words, this <a href=\"https:\/\/www.humanium.org\/en\/hungary\/\">Hungarian<\/a> law does not protect children, it protects an anti- LGBTQI+ ideology.&nbsp;<\/p>\n\n\n\n<p>We need to educate children, all children, on all important issues of life, including <a href=\"https:\/\/www.humanium.org\/en\/right-to-education\/\">sexual education<\/a> and gender identity.
