{"id":49122,"date":"2022-03-15T18:08:58","date_gmt":"2022-03-15T18:08:58","guid":{"rendered":"https:\/\/www.humanium.org\/en\/?p=49122"},"modified":"2025-12-05T16:14:35","modified_gmt":"2025-12-05T16:14:35","slug":"childrens-right-to-identity-sexual-orientation-gender-identity-and-gender-expression-sogie","status":"publish","type":"post","link":"https:\/\/www.humanium.org\/en\/childrens-right-to-identity-sexual-orientation-gender-identity-and-gender-expression-sogie\/","title":{"rendered":"Children\u2019s right to identity &#8211; sexual orientation, gender identity and gender expression (SOGIE)"},"content":{"rendered":"\n<p><strong>When individuals are asked about their sexual orientation, gender identity or expression (SOGIE), they often begin their stories saying: \u201cI knew I was different (&#8230;)\u201d (Marques, 2020). That suggests that society tells us that there is a \u2018normal\u2019 sexuality and gender identity. <\/strong><a href=\"https:\/\/www.humanium.org\/en\/child-rights\/\"><strong>Children<\/strong><\/a><strong> mostly grow up within an environment that conveys categories that are standards regarding their SOGIE.&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>Naturally, children whose feelings and expressions do not fit these categories are not accommodated by educational settings, families, and <\/strong><a href=\"https:\/\/www.humanium.org\/en\/health-2\/\"><strong>health<\/strong><\/a><strong> policies. That is a significant burden for children\u2019s health, well-being and development. The law must meet all children\u2019s needs regardless of their <\/strong><a href=\"https:\/\/www.humanium.org\/en\/adolescents-sexuality\/\"><strong>sexual orientation<\/strong><\/a><strong>, gender expression and identity. The <\/strong><a href=\"https:\/\/www.humanium.org\/en\/identity\/\"><strong>right to identity<\/strong><\/a><strong> codified in Article 8 of the <\/strong><a href=\"https:\/\/www.humanium.org\/en\/convention\/\"><strong>Convention of the Right of the Child (CRC)<\/strong><\/a><strong> can and should promote a children\u2019s right to SOGIE and protect all possible identities.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Social constraints regarding SOGIE<\/strong><\/h2>\n\n\n\n<p>One of the first actions taken towards the child is <a href=\"https:\/\/www.humanium.org\/en\/stateless-invisible\/\">gender assignment<\/a>. The registration of gender is mandatory, and in most countries, there are only two options, male and female (Brink &amp; Tigchelaar, 2014).<\/p>\n\n\n\n<p>Since gender assignment is usually carried out when children are still infants, it is performed without consultation. In most environments and societies where children grow up, the assignment of a particular gender is accompanied by certain expectations towards children\u2019s behaviours and actions (Dunne, 2018).<\/p>\n\n\n\n<p>For instance, they are expected to wear certain clothes or adapt to the cultural roles connected to \u2018<a href=\"https:\/\/www.humanium.org\/en\/girls-rights\/\">girl<\/a>\u2019 or \u2018boy\u2019. Whether children feel comfortable in these roles and behaviours is often not questioned. In addition, because they are expected to identify with their assigned gender, there is usually little room for their development independent of these social images (Dunne, 2018).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Discrimination, stigmatization and violence against LGBTIQ+ children<\/strong><\/h2>\n\n\n\n<p>Children who do not identify with their assigned gender, whose sexual orientation is not heterosexual or whose expressions are not in line with gender stereotypes (such as \u201cboys should not wear dresses\u201d) are frequently exposed to stigmatization, violence and <a href=\"https:\/\/www.humanium.org\/en\/discrimination\/\">discrimination<\/a> (UNESCO, 2016).These situations are experienced in everyday life within <a href=\"https:\/\/www.humanium.org\/en\/school-bullying\/\">school settings<\/a>, <a href=\"https:\/\/www.humanium.org\/en\/family-and-childrensrights\/\">family environments<\/a> and health policies(Committee, 2016).<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-1024x683.jpg\" alt=\"\" class=\"wp-image-49130\" srcset=\"https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-1024x683.jpg 1024w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-300x200.jpg 300w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-768x513.jpg 768w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-1536x1025.jpg 1536w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-2048x1367.jpg 2048w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-830x554.jpg 830w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-230x154.jpg 230w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-350x234.jpg 350w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-480x320.jpg 480w, https:\/\/www.humanium.org\/en\/wp-content\/uploads\/2022\/03\/shutterstock_1066233650-272x182.jpg 272w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Several studies show that lesbian, gay, bisexual, transgender, intersex, queer, questioning, and gender non-conforming <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">(LGBTIQ+) children<\/a> are more likely to be exposed to violence within educational institutions than their non-LGBTIQ+-peers(UNESCO, 2016).Also, in their family environment, children whose sexual orientation, gender identity, or expression differ from the majority experience violence or are rejected by their families(Horn, Peter, &amp; Russell, 2017). <a href=\"https:\/\/www.humanium.org\/en\/abuse\/\">Abuse<\/a>, discrimination and rejection of LGBTIQ+ children can result in long-term health issues, homelessness, social exclusion and poverty (The CRC Committee et al., 2015)<em>.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lack of protection of children\u2019s SOGIE within the CRC<\/strong><\/h2>\n\n\n\n<p>In light of this, the question that arises is to what extent does the <a href=\"https:\/\/www.humanium.org\/en\/convention\/text\/\">Convention on the Rights of the Child<\/a> (CRC), the most ratified human rights treaty, address children\u2019s needs regarding SOGIE. Looking at the provisions of the CRC, there is no explicit right that protects children\u2019s SOGIE. The absence of clear <a href=\"https:\/\/www.humanium.org\/en\/protection\/\">protection<\/a> in the Convention of the Rights of the Child concerning sexuality and gender gives States room to restrict children\u2019s freedom to live out their SOGIE.<\/p>\n\n\n\n<p>Several Articles within the Convention, such as the <a href=\"https:\/\/www.humanium.org\/en\/fundamental-rights\/freedom\/\">freedom<\/a> of expression and access to information, as well as freedom of thought, conscience, and religion, codify the possibility of restricting children\u2019s rights based on morals or other grounds (Horn, Peter, &amp; Russell, 2017). Often States interpret concepts like &#8216;morals&#8217; so that only specific gender identities and sexual orientations such as a heterosexual orientation are considered &#8216;normal&#8217;. Thus, the ambiguous language of the CRC makes it possible for States to justify discriminatory laws and policies against <a href=\"https:\/\/www.humanium.org\/en\/lgbtq-children\/\">LGBTIQ+ children<\/a> (Horn, Peter, &amp; Russell, 2017).As a result of this, there is an urgent need to address the lack of protection of LGBTIQ+ children.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Steps forward \u2013 ensuring the right to identity<\/strong><\/h2>\n\n\n\n<p>Which right could protect children&#8217;s identity in terms of sexual orientation, gender identity and expression better than the <a href=\"https:\/\/www.humanium.org\/en\/identity\/\">right to identity<\/a> enshrined in Article 8 of the Convention on the Rights of the Child?<\/p>\n\n\n\n<p>The right to identity states that the child\u2019s identity must be protected (CRC, Article 8). According to Article 8 CRC \u2019identity\u2018 includes name, nationality and family relations (CRC, Article 8). But the word &#8216;includes&#8217; allows other elements of Article 8 to be protected as well(Tobin, 2019). The <a href=\"https:\/\/www.humanium.org\/en\/committee\/\">CRC Committee<\/a> seems to understand identity more and more as a dynamic concept that is also about recognizing children\u2019s individuality and that sets them apart from their peers.<\/p>\n\n\n\n<p>Accordingly, individual sexuality and gender identity and expression as a natural part of children\u2019s identity must be safeguarded under <a href=\"https:\/\/www.humanium.org\/en\/identity\/\">the right to identity<\/a> (Sandberg, 2015). As a result, children must be granted <em>to develop<\/em> independently in relation to their sexual orientation, gender identity and expression, which is unquestionably necessary for their physical and mental well-being and for ensuring them to find their identity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><sup>States\u2019 duties in supporting children\u2019s identity development<\/sup><\/strong><\/h2>\n\n\n\n<p>States have to start complying with the understanding of identity encompassing a right to SOGIE. Such a right prohibits them from interpreting terms such as &#8220;morality&#8221; in a way that <a href=\"https:\/\/www.humanium.org\/en\/nondiscrimination\/\">discriminates<\/a> against certain sexualities and gender identities. Therefore, States have to abolish <a href=\"https:\/\/www.humanium.org\/en\/justice-of-children\/\">laws<\/a> that only accommodate the needs of certain SOGIE.<\/p>\n\n\n\n<p>They must take reasonable measures (such as passing laws) to enable children to discover, develop, express and enjoy their identity (Tobin, 2019). States&#8217; duties include, for instance, adapting <a href=\"https:\/\/www.humanium.org\/en\/right-to-education\/\">school systems<\/a> that accommodate children of all sexual orientations, gender identities and expressions.<\/p>\n\n\n\n<p>Also, in the light of what has been said about the social constraints that come with gender assignment at birth, States should change those laws establishing that gender has to be decided at birth. The persons themselves should have the autonomy to determine their gender since their identity is at stake.
